Terms & Conditions AMBALA FOODS TERMS OF BUSINESS
AMBALA FOODS objective to deliver the choicest, the tastiest and the widest possible range of our food products (the "Products") with quality and freshness second to none, to our customers at home and abroad has taken a significant step forward with the launch of our website.
Before you place an order you should read the following:
Products, Ordering and Delivery Information
Terms and Conditions of Use
Privacy and Security Statement
(collectively referred to as the "Terms of Business") as these pages form part of our terms of business and contain important information about your order. None of the conditions herein affect your statutory rights according to the laws of England.
PRODUCTS, ORDERING AND DELIVERY INFORMATION
The full range of the Products can be viewed, selected and ordered online from our website and are subject to availability.
Nut Allergy Alert!
The cuisine and the nature of some of the age-old recipes we follow to manufacture our Products to the highest standards means that the ingredients we use in our manufacturing processes contain nuts or nut oil and, some of the other products, whilst not containing nuts or nut oil, are manufactured in an environment where nuts and nut oil are present and therefore, we always recommend that people with nut allergies check our product packaging for a nut warning and DO NOT consume such products.
The display of any product or service on the website is not an offer to sell and Ambala Foods shall be under no obligation whatsoever to supply the products or services ordered through our website. If you place an order this will be your offer to purchase the Products from us. We will acknowledge your order as soon as possible but will be under no obligation to supply the goods or services until we accept your order by providing written confirmation that we have the goods in stock and they are available at the prices specified. Access to our website is not to be taken as meaning that we will enter into any contract with you and we reserve the right to refuse any online transaction.
By submitting an order to us through our website you represent and warrant that the payment details on your order are valid and correct and that when your order is accepted and processed by us, payment was made in full.
If the billing details for your order are the same as your Delivery address details, by placing an order on our website you confirm that you are the person referred to in the Delivery address details. Otherwise, by placing an order, you confirm that you are the person referred to in the Billing details.
An e-mail confirmation of your order will be sent to the e-mail address you specified when placing your order. Please check that all details accurately reflect your requirements. Should there be any discrepancies, please e-mail us on email@example.com
Where an order requests several different items to be sent to the same address, then these may be despatched separately and therefore, we cannot guarantee delivery of all the items on the same day.
We do not advise recipients of impending deliveries. We are unable to accept responsibility for parcels after our various carriers have accepted these and risk will pass to you on dispatch.
We reserve the right to change or substitute the Products and packaging without prior notice. It may be necessary for us to substitute for an equal or higher priced item owing to the perishable nature of the Products and the fact that they are time-critical. If time is available, we will attempt to contact you.
Capacity to Contract
You are confirming by placing an order that you are not a minor and are aged 18 or over and have the capacity to enter into a contract with us.
We accept payment by Switch, Visa, American Express, Solo and Mastercard but not by means of any other card. We will obtain a sanction from the relevant card company prior to despatch and it is important for you to provide us with correct details such as but not limited to name, account address, card number, issue number, issue date and expiry date. We cannot accept liability for an order being delayed as a result of incorrect or invalid payment details being given to us.
The total value of your order will be displayed on the order confirmation screen. The displayed price is the amount in pounds sterling that you will pay. If you are ordering from a non-United Kingdom mainland address, the appropriate exchange rate prevailing at the relevant time will apply.
In the unfortunate event that your payment card is used fraudulently to make a purchase with Ambala Foods, you as a consumer are entitled to cancel the said payment(s). If payment has already been made, you the consumer are entitled in accordance with the standing Consumer Protection Distance Selling Regulations 2000 to a re-credit or to have all sums returned to you by the card issuer.
Our online ordering service is currently available for delivery in the United Kingdom of Great Britain and Northern Ireland, and the Channel Islands and the Isle of Man as well as all other countries.
All orders received by 1.00 p.m. on any normal working day (Monday to Friday, excluding Saturdays, Sundays and public holidays) can be despatched within 24 hours of your placing the order.
Please note that if you wish to have your goods delivered on Saturday, you must place your order on the Friday before 1.00 p.m. Otherwise orders placed after 1.00 p.m. on Friday will be processed on the following Monday and therefore delivered on Tuesday.
All orders are delivered in between the times of 8.00 a.m. to 6.00 p.m.
The shipping charges and specific delivery times to your delivery destination are stated in the Select Your Package page on our website.
All orders require a signature on delivery, which will usually occur between 8.00 a.m. to 6.00 p.m., Monday to Friday in the UK mainland only. Please ensure that someone is available to accept delivery during these hours. Should our courier be unable to deliver, a card will be left to inform the recipient how they can collect their parcel or arrange a re-delivery. It will then become the recipient's responsibility to contact our courier to arrange a suitable re-delivery date. If no contact is made re-delivery may be attempted without further contact with the recipient. We accept no liability for any loss or damage by reason of a delivery failure owing to the recipient not being available, or if the goods perish and become inedible as a result of non-delivery.
We can only deliver to the address you provide and enter when placing your order and cannot accept any liability for late or failed delivery if the stated address is incorrect. The delivery address must be a physical address and not a post box number to which no delivery will be made. Any deliveries to a business address shall be deemed to be completed if left at the reception area and a representative of that business signs a receipt.
We want you to be totally satisfied with the order you receive from Ambala Foods. If your goods are damaged in any way or you have received an incorrect order, please contact us by phone (+ 44 (0) 1707 397 050 ext 9236) or e-mail (firstname.lastname@example.org) where we will be happy to credit the appropriate amount. We can also arrange for the goods to be picked up by our couriers at no extra cost to you. If your goods do not arrive at the specified time, you are entitled to refuse delivery for which you will be refunded.
Seasonal †Delivery Periods
The postal and other delivery services will be extremely busy over periods† such as Eid, Diwali and Christmas delivery times may take longer than usual for which we cannot be responsible as these matters are beyond our control.
We do not recommend shipping some of our perishable products to warm countries as our products are temperature sensitive. We cannot accept any liability, which is hereby excluded to the full extent permitted by the laws of England, for any perished Products when shipped outside UK mainland areas owing to the fact that we have no control over temperature during transit.
Cancelling the Order
When shopping with Ambala Foods, you can be assured of complete peace of mind. No cancellation is available for our 24 hours delivery service after the order has been placed. If you wish to cancel your order please telephone our Customer Services department on 0845 003 5655
